Introduction to First National Bank eBank
Agreement Definitions: This
"Agreement" explains the terms and
conditions governing the use of First
National Bank of Montana's Internet Banking
Services. The terms within this Agreement
are as follows:
The term "we," "us," "our," and "Bank"
refers to First National Bank of Montana.
"You" refers to each signer on an account.
The term "business day" shall mean every day
except Saturdays, Sundays and federal
holidays. The term "Agreement" refers to the
First National Bank of Montana Internet
Banking Agreement. The term "Internet
Banking Services" refers to all of First
National Bank of Montana's electronic
banking services (including, but not limited
to funds transfers and bill payment) will be
referred to collectively as "Internet
Banking Services" in this Agreement.
First National Bank eBank can be used to
access certain accounts at First National
Bank of Montana. The applicable "Your
Account Terms and Conditions", and
supplemental disclosures, you received upon
the opening of existing accounts continue to
govern each of your accounts.
You and First National Bank eBank:
This "Agreement" for accessing your accounts
via "eBank" explains the terms and
conditions that govern, regulate and protect
the integrity of data which electronically
transacts and communicates the products and
services between you and First National Bank
of Montana. The accounts that may be
accessed via "eBank" include only accounts
maintained at First National Bank of
Montana.
Venue of First National Bank eBank:
You agree that Montana state law and
applicable federal regulation and law shall
govern your use of the First National Bank
of Montana web site, eBank and all
transactions between you and First National
Bank of Montana. You agree that jurisdiction
and venue shall be located in Montana. First
National Bank of Montana reserves the right
to determine eligibility for any product or
service.
Terms and Conditions
By accessing the First National Bank of
Montana (FNBM) web site and/or web services:
1) Agreement Acknowledgement: I agree
that my use of the Internet Banking Services
will confirm that I have completed and
reviewed this Agreement and applicable
disclosures, both of which FNBM may amend
from time to time. By using any of FNBM's
Internet Banking Service in connection with
my account(s) at FNBM, I agree to be bound
by these terms and conditions and of the
Deposit Account Terms and Conditions. FNBM
reserves the right to revise these terms and
conditions, without prior notification, at
any time.
2) Security: I certify that I am
authorized to use the pin and password to
access internet banking services provided by
FNBM. I understand that my Password and PIN
can be used to expend funds from my account
and that this code MUST be safeguarded. I
take responsibility for safeguarding this
information and agree that I will not, under
any circumstances, disclose my Password or
PIN to any person.
I authorize FNBM and its agents to follow
any instructions transmitted by use of this
code, and I agree to be bound thereby. I am
liable for all transactions made or
authorized using my Password or PIN. FNBM
assumes all transactions authorized by my
Password or PIN are legitimate. If accessing
a business or non-commercial account, I
certify that I am authorized to use the
Password and PIN. If accessing a multiple
party account, I understand each person
authorizes any other signer(s) on the
account(s) and will be liable for all
transactions that are made on that account(s).
I will notify FNBM at once if I believe
another person has improperly obtained my
Password or PIN or has carried our
un-authorized transactions. At any time, I
may ask FNBM to disable my Password or PIN
and obtain a new one.
I understand passwords are case sensitive
with upper and lower case letter
capabilities. When I log in for the first
time with my bank assigned password, I
understand I must immediately change my
password. This is for my protection. For
added security, I understand I will be
prompted to change my password every three
months. I understand pin and password
requirements may vary for the following
internet banking services:
- eBanking
- eCorp
- ePay Consumers
- ePay Business
FNBM has contracted for additional levels
of protection referred to as Multifactor
Authentication for the above internet
banking services. I understand additional
password verification systems including:
image verification, token verification,
individual challenge questions or a
combination of, may be required depending on
the type of internet banking service. I can
learn more about Multifactor Authentication
by taking the on-line customer education
tutorial provided by FNBM.
3) System Availability: To access
eBank you must have a browser that supports
128-bit encryption. There are upgrades for
Microsoft Internet Explorer version 5.0 or
greater, or Netscape Navigator version 6.1
or greater, which provide this encryption.
We have placed links for you to access these
upgrades on our System Requirements page. If
you wish to use a different browser, you
will need to contact the provider of the
browser you wish to use to get the proper
128-bit encryption.
FNBM's internet services will generally be
available 24 hours a day, 7 days a week,
except for scheduled maintenance. In no
event shall FNBM be liable for any damages
whatsoever which arise out of or related to:
your ability to use or access FNBM's
internet services; your reliance on any
information provided via our website; or any
other failure of performance, error,
omission, interruption, defect, or any loss
or delay in transmission.
4) Account Information: I understand
balancing information available through
FNBM's web services may not reflect
outstanding checks, charges, or unposted
transactions. Pending transactions are
transactions that are presented to the Bank
during the current business day or after the
processing cut-off time for the previous
business day (which varies between 4:00pm
and 6:00pm). Pending transactions may
include a variety of items including, direct
deposits, ACH items, ATM transactions, and
check card transactions.
5) Contact Us: I can send an email as
a way of communicating with the Bank's
customer support personnel. I may contact us
24 hours a day, 7 days a week via email
"Contact Us" available on the website. I
understand typical response to my email
inquiry is during regular business hours, 8
am to 5 pm Monday through Friday, excluding
federal observed holidays.
IMPORTANT: Do not rely on email
communication when reporting a lost or
stolen PIN, Password, Credit Card, debit
Card, or ATM Card. Do not send transfer or
payment requests via email. I understand my
identity cannot be confirmed when using
email communications.
6) Site Tools: I understand nothing
on FNBM's website is intended to provide
legal, accounting, tax or financial advise.
I should consult my advisor(s) on such
matters. Tools that I have access to through
the FNBM website (such as calculators,
financial templates, etc.) are provided for
my convenience, but are not guaranteed to be
error free.
General Terms and Disclosure
Product and Service Disclosure: We
reserve the right to change the fees or
other terms described in the Agreement at
any time. This does not include any changes
to your "Account Terms and Conditions" you
received when opening your account. Changes
in Account Terms will always be mailed to
you at least 30 days in advance of the
change. Any charges, fees or other terms
changed that affect this Site will be posted
at this Site.
NOTICE: All transactions conducted over
eBank are considered by the federal
government as electronic "telephonic"
transfers and considered "third party
transfers" and are limited in number per
statement cycle (month) for certain accounts
under the Federal Reserve Act (Reg D). Refer
to the disclosure that details the
transactions allowed under Reg D that you
were provided upon opening of a savings,
money market or tiered interest account.
Funds Availability: The following
disclosure was provided to you upon opening
a transaction (checking) account at First
National Bank. This is also disclosed here
to help you clearly understand when your
funds are available after deposits are made
when setting up a Bill Payment.
Your Ability To Withdraw Funds At First
National Bank of Montana
This policy statement applies to
"transaction" accounts. Transaction
accounts, in general, are accounts that
permit an unlimited number of payments to
third persons and an unlimited number of
telephone and pre-authorized transfers to
other accounts of yours with us. Checking
accounts are the most common transaction
accounts. Feel free to ask us whether any of
your other accounts might also be under this
policy.
Our policy is to make funds from your cash
or check deposits available to you on the
first business day after the day we receive
your deposit. Electronic direct deposits
will be available on the day we receive the
deposit. Once the funds are available, you
can withdraw them in cash and we will use
the funds to pay checks that you have
written. Please remember that even after we
have made funds available to you and you
have withdrawn the funds, you are still
responsible for checks you deposit that are
returned to us unpaid and for any other
problems involving your deposit.
For determining the availability of your
deposits, every day is a business day,
except Saturdays, Sundays, and federal
holidays.
If you make a deposit before deposit cut-off
time on a business day that we are open, we
will consider that day to be the day of your
deposit. However, if you make a deposit
after deposit cut-off time or on a day we
are not open, we will consider that the
deposit was made on the next business day we
are open. Deposit cut-off times vary
somewhat by bank office, but are not earlier
than 4:00 p.m.
If we cash a check for you that is drawn on
another bank, we may withhold the
availability of a corresponding amount of
funds that are already in one of your
accounts. Those funds will be available at
the time funds from the check we cashed
would have been available if you had
deposited it.
Longer Delays May Apply
Case-By-Case Delays - In some cases, we will
not make all of the funds that you deposit
by check available to you on the first
business day after the day of your deposit.
Depending on the type of check that you
deposit, funds may not be available until
the fifth business day after the day of your
deposit. The first $100 of your deposits,
however, may be available on the first
business day after the day of your deposit.
If we are not going to make all of the funds
from your deposit available on the first
business day after we receive your deposit,
we will notify you at the time you make your
deposit. We will also tell you when the
funds will be available. If your deposit is
not made directly to one of our employees,
or if we decide to take this action after
you have left the premises, we will mail you
the notice by the first business day after
we receive your deposit.
If you will need the funds from a deposit
right away, you should ask us when the funds
will be available.
Please Note:
You are responsible for reading and
accepting the Electronic Disclosures. By
completing the Internet Banking Application
and using any or all Internet Banking
Services (i.e., eBank, ePay Consumer, ePay
Business, eCorp, etc.) you acknowledge that
you have read and accepted these Disclosures
in addition to disclosures provided at
account opening.
